Aineistokuvaus

Käyttäjät

Auktorisoituja käyttäjiä ovat tilaajaorganisaation
- koko- ja osa-aikaiset opettajat, tutkijat, dosentit ja muu henkilölunta
- organisaation eläkkeellä olevat opettajat, tutkijat ja muu henkilökunta.
- ulkoistettu opetus- ja muu henkilökunta vain suorittaessaan palvelua tilaajaorganisaatiolle
- opiskelijat
- kirjaston paikallisasiakkaat. Heillä on oikeus käyttää aineistoa vain tilaajaorganisaation fyysisissä tiloissa, mutta ei etäkäyttönä.

Sallittu käyttö

Aineistoa saa käyttää opetukseen (myös etä), henkilökohtaiseen opiskeluun (myös etä), tutkimukseen, tiedonhakuun (kaikissa tapauksissa omaan tai toisten auktorisoitujen käyttäjien käyttöön). Kaupallinen käyttö on kielletty.

Auktorisoidut käyttäjät saavat edellä mainittuihin tarkoituksiin:

-selailla, katsella, tehdä hakuja näyttää aineistoa ruudulta

- kopioida ja liimata sekä tallentaa elektronisesti ja tulostaa ja valokopioida yksittäisiä artikkeleita, kirjan lukuja tai muita yksittäisiä kohteita

- esitellä julkisesti yksittäisiä artikkeleita, kirjan lukuja tai muita yksittäisiä kohteita osana esitystä seminaarissa, konferenssissa, workshopissa tai akateemisessa kokouksessa (ml. online tilaisuudet)

- jakaa yksittäisiä kopioita yksittäisistä artikkeleista, kirjan luvuista tai muista yksittäisistä kohteista paperi tai sähköisessä muodossa toisille auktorisoiduille käyttäjille, mukaan lukien kopioiden jakaminen aineiston tilaajaorganisaation opiskelijoille organisaation tarjoamilla kursseilla tapahtuvaa opetusta varten.

- jakaa satunnaisesti yksittäisiä kopioita yksittäisistä artikkeleista, kirjan luvuista tai muista yksittäisistä kohteista paperisena tai sähköisessä muodossa aineiston tilaajaorganisaation ulkopuolisille kollegoille tieteellistä tutkimusta ja kommunikointia varten tai käytettäväksi keskusteluryhmissä. Tällaisen jakamisen tulee olla satunnaista ja ei-systemaattista.

- käyttää yksittäisiä kopioita yksittäisistä artikkeleista, kirjan luvuista tai muista yksittäisistä kohteista elektronisten ja paperimuodossa olevien kurssipakettien, aineistolistojen ja muiden materiaalien valmistamisessa käytettäväksi opetuksessa ja/tai virtuaaliympäristöissä (esim. virtuaaliset opiskelu-, ja tutkimus- ja kirjastoympäristöt) suojatussa verkossa. Käytetyn aineiston tulee sisältää asianmukaiset lähdeviitteet (lähde, nimeke, tekijänoikeuden haltija). Lukemisesteisille auktorisoiduille käyttäjille on lupa tehdä ei-elektronisessa, ei-painetussa muodossa olevia kurssipaketteja (esim. Braille). Aineiston sisältöön ei kuitenkaan saa tehdä muutoksia. Mikäli muuntaminen uuteen muotoon johtaa immateriaalioikeuksien syntymiseen, kuuluvat ne kustantajalle.

- artikkelin tai kirjan luvun kirjoittaneella auktorisoidulla käyttäjällä on oikeus sisällyttää yksittäisiä artikkeleita tai kirjan lukuja paperi- tai elektronisessa muodossa väitöskirjaan. Näissä tulee olla asianmukaiset lähdeviitteet (lähde, nimeke, tekijänoikeuden haltija). Väitöskirjasta on lupa tehdä kopioita henkilökohtaiseen käyttöön sekä kirjaston kopioksi, mikäli se kuuluu organisaation normaaliin akateemiseen toimintatapaan. Auktorisoitu käyttäjä saa tehdä enintään 30 kopioita tämän lausekkeen perusteella.

Mikäli yksittäisen aineiston (esim. artikkeli) yhteydessä ilmoitetaan, että sen käyttöä koskee open access lisenssin ehdot, noudatetaan kyseisen lisenssin ehtoja.

Näiden sallittujen käyttötapojen lisäksi (ja niistä huolimatta) käyttäjä saa hyödyntää aineistoa siten kuin Suomen tekijänoikeuslaissa säädetään.

Kielletty käyttö

On kiellettyä:

- poistaa, peittää tai muuttaa aineistossa tai palvelussa olevia tekijänoikeus- tai muita merkintöjä, tavaramerkkejä, logoja tai muita yksinoikeusmerkintöjä. Edellä mainittu on kuitenkin sallittua silloin, jos niin on erikseen muualla näissä ehdoissa todettu.

- päivittää, muuttaa, muokata, adaptoida, kääntää tai muuntaa aineistoa taikka luoda aineistosta johdannaisteosta, muutoin kuin on välttämätöntä aineiston tekemiseksi näkyväksi ruudulta, pois lukien muutokset aineiston sisältöön. Edellä mainittu on kuitenkin sallittua silloin, jos niin on erikseen muualla näissä ehdoissa todettu.

- levittää, jäljentää tai lähettää aineistoa millään tavalla mukaan lukien elektronisesti (esim. s-posti, FTP) tai postata sitä henkilökohtaisille tai julkisille webbisivuille tai julkiseen verkkoon paitsi jos se on erikseen sallittu edellä olevissa käyttöehdoissa tai sovellettavassa laissa

- systemaattisesti tallettaa aineistoa omalle tai kolmannen osapuolen palvelimelle

- kohdistaa aineistoon automaattinen jatkuva haku ja ideksoida sisältöä (ml. kokoteksti ja metatieto), esim. web-crawiling ja spidering tai muuten toimia tavalla joka rasittaa alustaa (yhden sivun URL haku per sekunti tai kustantajan yhden API käyttö per sekunti ei rasita alustaa). Edellä mainittu on kuitenkin sallittua silloin, jos niin on erikseen muualla näissä ehdoissa todettu.

- käyttää itse tai auttaa kolmatta osapuolta käyttämään aineistoa suorasti tai epäsuorasti kaupalliseen tarkoitukseen (myynti, jälleenmyynti, lainaaminen, vuokraaminen tai muu taloudellinen hyväksikäyttö, aineiston siirtäminen kolmannen osapuolen sisäiselle tai julkiselle verkkosivulle tai veloittaminen pääsystä aineistoon). Kaupallisena käyttönä ei pidetä kopiointi tms. suorien tai lain edellyttämien kulujen perimistä käyttäjiltä, kaukopalvelukulujen perimistä toiselta kirjastolta/tietopalvelulta, aineiston käyttämistä maksullisissa koulutusohjelmissa, aineiston käyttämistä kaupallisen toimijan rahoittaman tutkimuksen tekemiseen eikä aineiston käyttämistä lähteenä käyttäjän omien julkaisujen tuottamiseen ja sen siteeraamista omissa julkaisuissa.

- muulla tavoin käyttää aineistoa tavalla joka loukkaa tekijänoikeutta tai muita yksinoikeuksia.

Description

A multi discipline journals collection of 2216 titles.

Authorised users

Authorized Users” means Licensee’s
- full- and part- time faculty members, staff, docents, researchers
- contractors provided that use by a contractor of Licensee is authorized solely to the extent it is for the benefit of Licensee, and not for the benefit of the contractor or any third party
(all of the aforementioned, whether on a permanent, temporary, contract or visiting basis)
- outsourced faculty and/or staff in their performance of services for and on behalf of the Licensee only
- retired faculty, staff and researchers of the Licensee
students of the Licensee
- walk-in users who are permitted to access from computer terminals or otherwise within the physical premises of the Licensee

Permitted use

Use is permitted for Educational Purposes (teaching and education, distance learning, private study, retrieving information and/or research, in each case only for personal use or use by other Authorized Users). Commercial Use is not permitted.
Authorized Users may:
- access (including by remote access, with the exception of Walk-in Users), browse, view, collate, display, search and retrieve the Content,
- download, copy paste, save and store on electronic media, print and photocopy single articles, chapters or other individual items of the Content,
- use single articles, chapters or other individual items of the Content for the preparation of printed and electronic course materials, study packs, resource lists and in any other material hosted on a Secure Network with all rights notices duly presented.
- distribute single articles, chapters or other individual items of the Content in print or electronic form to other Authorized Users.
- distribute single copies of single articles, chapters or other individual items in the Content in print or electronic form including email to third parties outside the Licensee for the purposes of scientific research and communication or to be used for the basis of discussion groups. This sharing must be incidental and non-systematic.
- publicly display or publicly perform single articles book chapters or portions thereof or other individual items of the Content as part of a presentation at onsite and/or online seminar, conference, or workshop and academic meetings.
Parts of the Content may be licensed under open access license Terms (“Open Access Content”) and in such cases those license terms govern the use.
Text and Data Mining
“Text and Data Mining” (“TDM”) means (i)performing automated searches, selection of content, and structured analyses of content including data embodied therein (ii) the sorting, parsing, addition or removal of linguistic structures, and the selection and inclusion of discrete parts of content into another form for educational, scientific or research purposes such as classification or recognition of relations, patterns, and associations (iii)the extraction, alternative representation or translation, expression or discussion of any extracts from mined content, whether in the form of a direct extraction or a representation in any form.
“TDM Materials” means the materials, data and information created for or during TDM based on the Content.
“TDM Output” means the data and information which is the result of any TDM, excluding any verbatim duplication of the Content in whole or in part. Authorized Users may however use parts of the Content for citation purposes in connection with the TDM Output, if and to the extent such citations is allowed by Finnish copyright law.
Authorized Users may
- download and/or extract information from the Content for the purpose of TDM to a server or computer which is part of Licensee’s Secure Network and only accessible to Authorized Users and Licensee (“Internal Server”),
- perform TDM on such Content and/or TDM Materials for the duration of a specific TDM project.
- internally store electronic copies of the Content and the TDM Materials limited to such quantities as necessary to ensure efficient use by Authorized Users in connection with their work on a TDM project. Such storage shall be limited to the duration of the TDM project. Copies of Content and the TDM Materials shall be deleted promptly after the end of each TDM project except for such copies that are not copyright protected according to applicable Finnish Copyright law or for copies of Content and/or TDM Materials to which exceptions of copyright under Finnish Copyright Law apply and which have been lawfully made at the time of creation.
- make the TDM Output available to third parties, subject to the limitations in these terms.

Prohibited use

Neither Licensee nor Authorized Users shall:

- remove, obscure or alter any copyright or other notices, trademarks, logos, service marks or any other proprietary rights appearing in or on the Content except as otherwise permitted in these user terms.

- update, change, revise, adapt, modify, translate, transform or create any derivative work of the Content except to the extent necessary to make it perceptible on a screen excluding any changes to the substance of the Content or as otherwise permitted in these user terms

- except as permitted in these user terms or by applicable law, redistribute, reproduce, or transmit the Content by any means including electronic (e. g., via e-mail, FTP) nor post it on personal or public websites or on public networks,

- systematically download any Content to its own or any third-party server, use routines designed to continuously and automatically search and index the Content (including its full text and metadata), such as web-crawling or spider programs, or engage in any activity likely to burden the Platforms (for avoidance of doubt one request per second is not deemed likely to burden the Platforms. One request means the usage of one of Licensor’s API’s per second (application programming interface) or one fetch of a page URL per second)) except as otherwise permitted in these user terms,

- directly or indirectly use or assist any third party to use the Content for any Commercial Use; or

- otherwise use the Content in a manner that would infringe the copyright or other proprietary rights contained therein.

Additional prohibitions regarding TDM

Authorized Users may not
- commercially use or allow commercial use of the TDM Output including but not limited to creation of derivative products or services that would compete with or negatively affect Licensor or Licensor’s Affiliates products or services,

For the avoidance of doubt: The use of TDM Output for scientific publication (either offline and online) does not constitute commercial use in the aforementioned way

- allow a third party to access or use any TDM Materials

- perform TDM for a third party

- store Content or TDM Materials on any server other than an Internal Server.

Additional information
